1. Agreement to Terms

By accessing or using Stay Avenue ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform, whether registered or not.

2. Description of Service

Stay Avenue is an online platform that connects property owners ("Landlords") with individuals seeking rental accommodations ("Tenants"). We provide:

  • Property listing services for Landlords
  • Property search features for Tenants
  • Communication tools between Landlords and Tenants

Important: Stay Avenue is NOT a real estate agency, broker, or property management company. We are solely a platform that facilitates connections between parties.

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our services.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to the Platform or other users.

4. User Responsibilities

4.1 For Property Owners (Landlords)

By listing a property, you represent and warrant that:

  • You have legal authority to rent the property
  • All listing information is accurate and truthful
  • All photos are genuine and represent the actual property
  • The property complies with applicable laws and regulations
  • You will not discriminate against any potential tenant
  • You will respond to inquiries in a timely manner

4.2 For Tenants

By using the Platform to search for rentals, you agree to:

  • Provide accurate information during inquiries
  • Conduct your own due diligence before renting
  • Verify property details directly with the landlord
  • Not misuse the messaging system for spam or harassment

5. Prohibited Activities

You agree NOT to engage in any of the following:

  • Posting false, misleading, or fraudulent listings
  • Impersonating any person or entity
  • Harassing, threatening, or abusing other users
  • Sending spam, unsolicited advertisements, or promotional materials
  • Collecting user information without consent
  • Attempting to hack, disrupt, or damage the Platform
  • Using the Platform for illegal activities
  • Circumventing security features
  • Scraping or data mining our content
  • Posting properties you do not own or have authority to rent
  • Discrimination based on race, religion, gender, or other protected characteristics

6. Listing Content

6.1 Content Ownership

You retain ownership of the content you post (text, photos, etc.). However, by posting, you grant Stay Avenue a non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating the Platform.

6.2 Content Moderation

We reserve the right to review, modify, or remove any listing or content that:

  • Violates these Terms
  • Is fraudulent or misleading
  • Contains inappropriate or offensive material
  • Infringes on intellectual property rights

6.3 Listing Approval

All new listings are subject to review before being published. We may reject listings at our sole discretion without providing reasons.

7. Fees and Payments

Currently, Stay Avenue offers free listing services. We reserve the right to introduce fees for premium features or services in the future, with prior notice.

Any rental transactions, deposits, or payments between Landlords and Tenants are conducted directly between the parties. Stay Avenue is not responsible for any financial transactions between users.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy or completeness of listings
  • Uninterrupted or error-free service
  • Security of the Platform

We do not verify the accuracy of listings, the identity of users, or the quality of properties. Users must conduct their own due diligence.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAY AVENUE SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, or consequential damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage resulting from rental transactions
  • Actions or omissions of any third party
  • Fraudulent listings or user misconduct
  • Disputes between Landlords and Tenants

Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Stay Avenue, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the Platform
  • Any rental transactions you engage in

11. Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be:

  • First, attempted to be resolved through informal negotiation
  • Governed by the laws of India
  • Subject to the exclusive jurisdiction of courts in Hyderabad, India

Disputes between Landlords and Tenants are solely between those parties. Stay Avenue is not obligated to mediate or resolve such disputes.

12. Intellectual Property

The Stay Avenue name, logo, website design, and all related intellectual property are owned by us. You may not use, copy, or reproduce our intellectual property without prior written consent.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and revising the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
